PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE konex PLATFORM. BY ACCESSING OR USING THE konex PLATFORM, YOU ARE DEEMED TO HAVE AGREED TO THIS PRIVACY POLICY.

Effective March 2019

  1. GENERAL

    • 1.1 This konex Privacy Policy (this "Policy") sets out and explains how konex collects, uses, stores, processes or transfers the personal information of Users.

    • 1.2 Capitalized terms used but not defined in this Policy have the meaning ascribed to them in the konex Terms & Conditions.

    • 1.3 konex will comply with the Act on the Protection of Personal Information and other applicable laws and regulations (including guidelines issued by the Personal Information Protection Committee). konex will also comply with konex’s internal regulations and contracts to which konex is a party in handling personal information.

  2. PURPOSES OF USE

    • 2.1 konex will use personal information only to provide, maintain, and improve the konex Platform and Services; to respond to inquiries about Services, and as well as third party services that konex utilizes.

    • 2.2 konex may from time to time add, alter, remove or otherwise amend the purposes of use set forth in Clause 2.1, upon which konex will announce and notify Users of such amendment.

  3. SAFE HANDLING OF PERSONAL INFORMATION

    • 3.1 konex will take necessary and appropriate measures and work to protect the security of personal information. For instance, during transmission konex will use Secure Sockets Layer (SSL) software, which encrypts the information Users input. konex will also use a secure server hosting location in Japan, firewall protection, controlled access and encryption technology to protect User Data.

    • 3.2 Please be advised that while konex strives to protect User’s personally identifiable information, konex cannot guarantee the security of any information Users disclose or transmit to konex online and are not responsible for the theft, destruction, or inadvertent disclosure of this data.

  4. OUTSOURCING AND SUPERVISION

    • 4.1 konex may outsource all or part of the handling of personal information to a third party as necessary, in which case konex will require such third parties to confirm in writing, and supervise such third parties, to ensure the appropriate handling of the personal information.

  5. PROVISION OF PERSONAL INFORMATION

    • 5.1 konex will not provide personal information to third parties in a manner by which individuals can be identified, except for provision of personal information to a third party for outsourcing purposes as set forth in Clause 4.1; if so ordered by a court, governmental authority or self-regulatory bodies (including securities exchanges); or if so required or permitted by applicable laws and regulations.

  6. ACCURACY AND UPDATE

    • 6.1 konex will use all reasonable efforts to maintain personal information held by it in an accurate and up-to-date manner.

    • 6.2 Each User should provide konex with accurate User Data and should, in the event of any change in the User Data provided to konex, update such User Data to reflect such change on the konex Platform. Please be advised that konex will not be responsible for any Losses that may be incurred or any inconvenience that may be caused due to any User’s failure to provide accurate User Data or to update User Data.

  7. REQUEST FOR DISCLOSURE, CORRECTION OR CESSATION TO USE

    • 7.1 Users may, on their own or through an agent, request that konex disclose, correct, or cease to use, their personal data retained by konex, where the requesting User or agent will provide konex with identification documents or information (such as a copy of his or her driver’s license or passport) and, in the case of an agent, a document evidencing its power of attorney. Once the identification is confirmed, konex will take any necessary steps to respond to such request without delay (or in any case, within a time period prescribed by applicable laws or regulations), except:

      • (a) where doing so would entail a risk of harming the life, body, property or other rights of the User or a third party;

      • (b) where doing so would entail a risk of substantial impediment to the konex Platform or the business or operations of konex or any of its subsidiaries;

      • (c) or where doing so would violate applicable laws or regulations.

  8. USE OF COOKIES

    • 8.1 Cookies are small files that konex places on your computer or in your Web Browser memory to enable konex’s systems to recognize your browser and to provide convenience and other features to you. It is important to note that the cookies that konex use do not contain and are not tied to personally identifiable information about you.

    • 8.2 You may be able to set your browser to not to allow cookies and delete existing cookies. Please note however that some elements of konex’s services will not function properly or be available without cookies enabled.

    • 8.3 Third-party cookies allow the tracking of your online activity, often for the purposes of targeted advertising by third-party services. konex does not use any third-party cookies of this type on any konex web service.
